Is the time limit for bringing an Employment Tribunal claim going to be extended?
6th November 2018
Currently, Employment Tribunal claims for unfair dismissal and discrimination claims must be brought within 3 months of the employment relationship ending or of the act of discrimination occurring. Redundancy pay and Equal Pay claims have a 6-month time limit.
The Law Commission is now consulting on a range of proposals to the Employment Tribunal system including increasing the time limit for bringing a claim to 6 months. The consultation closes on 11 January 2019.
Employment Tribunal fees were abolished in July 2017. Since then, the number of claims lodged with an Employment Tribunal has increased substantially, leading to a delay in the cases being heard.
