Right Of Appeal On Pay Decisions
12th September 2019
Teachers have a right to appeal against the decision on pay progression. The Schools Appraisal and or Pay Policy should set out the right of appeal and the process in which to follow.
Schools must ensure they follow the policy when dealing with an appeal in order to minimise risks such as constructive dismissal, breach of contract, claims of discrimination etc.
The appeal panel should be independent to the rest of the process and the employee has a right to attend the appeal hearing or put forward their case relating to the appeal.
Appeals should always state the grounds of appeal and it is important to remember that an appeal is not a rehearing, but an investigation into the grounds of appeal.
